These terms apply to Flowmind Social (“the service”) at https://smm.flowmind.digital, operated by Flowmind Digital (“we”, “us”). By creating an account or using the service you agree to them, together with our privacy policy, acceptable-use policy and refund policy, which are part of this agreement. If you use the service for a company, you confirm you may bind that company, and “you” means the company too.
1. Account and eligibility
- You must be at least 18 years old (or the age of majority where you live) and able to enter a contract.
- Give accurate details and keep your email address current — it is how we reach you about security and billing.
- You are responsible for everything done under your account and for keeping your password, sessions and API keys secret. Tell us at once at [email protected] if you suspect misuse.
- One person may hold one account; an account may own or belong to several workspaces.
2. The service
The service lets you connect Facebook Pages, YouTube channels and X accounts you are entitled to manage, plan and publish content to them, read and answer the comments and messages on them (yourself, with your team, or with an AI assistant you configure), see statistics, and connect outside AI tools through API keys. What each plan includes is described on the pricing page. We may improve, add or change features over time; if we remove a feature your plan depends on, we will tell you in advance.
3. Your content and your pages
- You keep all rights to the content you upload and publish and to your knowledge base. You give us only the licence needed to store, process, display and transmit it in order to provide the service to you — including sending it to the platforms you connect and to the AI providers described in the privacy policy.
- You confirm that you own or are authorised to manage every Page, channel and account you connect, and that you have the rights to everything you publish through the service.
- When you connect a platform you also agree to its rules, which apply on top of these terms: Meta’s Terms, Pages policies and Platform Terms; the YouTube Terms of Service, Community Guidelines and the Google Privacy Policy; and X’s Terms and Developer Agreement. If a platform suspends or limits your account or our app, we cannot publish or read for you until it is restored.
- You are responsible for the people you answer: for the content of replies sent from your Pages, for honouring Meta’s 24-hour messaging rule where you reply by hand, and for the personal data of your audience that appears in your workspace, in accordance with the privacy law that applies to you.
- We do not claim ownership of, review or endorse your content. We may remove content or stop a post that violates these terms, the acceptable-use policy or a platform’s rules, or that exposes us to legal risk.
4. AI-generated replies
- The assistant writes replies and drafts from the rules, voices and knowledge base you set up, using third-party language models. Language models can be wrong, out of date or oddly phrased. We design the assistant to state only what your knowledge base says and to hold anything it is unsure of for you, but we cannot guarantee that every reply is accurate or appropriate.
- You are responsible for every reply sent from your Pages, including replies the assistant sends. We recommend keeping each page in “ask me first” until you have reviewed enough drafts to trust it. Switching a page to auto mode is your decision and you may reverse it at any time.
- You must not configure the assistant to deceive people in ways the law or a platform forbids, to give professional advice (medical, legal, financial) as if from a qualified person, to harass, or to produce content that breaks the acceptable-use policy.
- AI replies on the platform’s allowance are metered as described on the pricing page. If you bring your own AI key, your agreement with that provider governs those requests and their cost.
5. Acceptable use
Our acceptable-use policy is part of these terms. In short: no spam, fake engagement or impersonation; no unlawful, hateful or deceptive content; respect each platform’s rules and rate limits; do not misuse API keys or try to get at data that is not yours.
6. Plans, trial and limits
- Every new workspace starts with a 14-day trial of the Pro plan. No card is required and there is nothing to cancel. When the trial ends the workspace moves to the Free plan unless you subscribe.
- Each plan has limits (pages, members, API keys, AI replies and scheduled posts per month, knowledge items, features). When a limit is reached the service tells you and asks you to upgrade; it does not delete anything. Limits are listed on the pricing page and may change for new subscriptions; we honour the limits you paid for until your current period ends.
- Moving to a smaller plan keeps your data. Features the new plan does not include pause, and you cannot add beyond the new limits until you remove items or upgrade.
- We may offer the trial once per customer and may decline it where we see abuse.
7. Payments and renewals
- Prices are in US dollars and are shown without tax. You are responsible for taxes that apply to you; where we must collect one, it is shown before you pay.
- Card. Card payments are processed by Stripe under its terms. Subscriptions renew automatically at the end of each monthly or yearly period until you cancel from the billing page. If a renewal charge fails we tell you and keep the plan running for a three-day grace period; after that the workspace moves to the Free plan until payment succeeds.
- bKash / Nagad. You send the amount shown in taka to the number displayed and enter the transaction id. A payment counts as made when we approve it, which we do by hand, normally within one working day. Your plan runs for a month or a year from approval and does not renew automatically — we remind you before it ends. If a payment cannot be matched, we tell you why and you may submit it again.
- Promotional prices apply for the period stated; after it the standard price applies. We may change prices with at least 30 days’ notice; the change applies from your next renewal.
8. Refunds and cancellation
You may cancel at any time; the plan stays active until the end of the period you paid for and is not renewed. Refunds are governed by the refund policy: a full refund within 7 days of your first payment for a plan if you have barely used it, no refunds on renewals, and manual payments refunded to the same bKash or Nagad number.
9. Teams, roles and API keys
- The workspace owner may invite members and assign roles. Members act on the owner’s behalf within their role; the owner is responsible for who is invited and what they do.
- API keys let outside software (such as ChatGPT or Claude) act in a workspace within the scope you give the key. Anything done with a key counts as done by the workspace. Keep keys secret and revoke them when no longer needed; we are not responsible for actions taken with a key you failed to protect.
- Members and keys see personal data of your audience; you must only grant access to people and tools you are entitled to share it with.
10. Suspension and termination
- You may stop using the service and delete your account at any time from the app; your data is deleted as described in the privacy policy.
- We may suspend or limit a workspace or account, after notice where practical, if it breaks these terms or the acceptable-use policy, puts the service or other customers at risk, causes a platform to warn or penalise our app, or has an overdue payment. We will lift a suspension when the cause is fixed.
- We may terminate an account for a serious or repeated breach, or if we stop offering the service (with at least 30 days’ notice and a pro-rated refund of any prepaid period in that case). After termination you can request an export of your content for 30 days unless the law forbids it.
11. Availability and support
We make reasonable efforts to keep the service available around the clock and to publish scheduled posts on time, but we do not guarantee uninterrupted service. Scheduled publishing also depends on the platforms, which fail or change from time to time; when a post cannot be published we tell you so you can act. The Free plan comes with no uptime commitment and community support; paid plans receive the support level shown on the pricing page. Planned maintenance is announced in the app where possible.
12. Intellectual property
The service, its software, design and documentation belong to Flowmind Digital and its licensors. We give you a limited, non-exclusive, non-transferable right to use the service under these terms. You may not copy, resell, reverse-engineer or build a competing product from it, or remove our notices. Feedback you give us may be used without obligation to you. The Flowmind Social name and logo are our marks; the names of the platforms and AI products belong to their owners.
13. Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that AI output will be accurate, that posts will reach any audience, that a platform will keep our app approved, or that the service will be error-free.
14. Limitation of liability
To the extent the law allows, Flowmind Digital is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, followers, reach, data or goodwill, arising from the service, from content published or replies sent through it (including by the assistant), or from a platform’s actions — even if we were told such damages were possible. Our total liability for all claims in any twelve-month period is limited to the amount you paid us for the service in that period (or USD 50 if you paid nothing). Nothing in these terms limits liability that cannot be limited by law.
15. Indemnity
You will defend and indemnify Flowmind Digital and its people against claims, losses and costs (including reasonable legal fees) arising from your content, the replies sent from your Pages, your breach of these terms or of a platform’s rules, or your violation of someone’s rights or of the law.
16. Governing law and disputes
These terms are governed by the laws of the People’s Republic of Bangladesh. The courts of Bangladesh have exclusive jurisdiction over any dispute, and you consent to their jurisdiction, without prejudice to consumer rights that cannot be waived where you live. Before going to court, please write to us — most problems are solved by a conversation.
17. Changes to these terms
We may update these terms. For material changes we give workspace owners at least 14 days’ notice by email or in the app; continuing to use the service after the change takes effect means you accept it. If you do not agree, cancel and delete your account before the effective date and we will refund any prepaid period beyond it.
